NEW YORK- A United Airlines (UA) passenger has filed a lawsuit claiming he was forcibly removed from an airplane bathroom with his pants down and subsequently detained by law enforcement.

The incident, which occurred on January 28, 2025, has drawn comparisons to the controversial removal of Dr. David Dao from a United flight in 2018.

According to court documents filed in a New York district court, Yisorel Liebb was aboard United flight UA1601 from Tulum, Mexico, to Houston when he used the lavatory shortly after takeoff.

After Liebb remained in the bathroom for approximately 20 minutes, a flight attendant grew concerned and contacted his traveling companion.

The friend spoke with Liebb through the door and informed the crew that Liebb was experiencing constipation but would exit soon. When Liebb had not emerged after an additional ten minutes, one of the pilots intervened, ordering the friend to persuade Liebb to leave the bathroom.

The lawsuit alleges that despite Liebb’s assurances that he was “just finishing up,” the pilot became “visibly enraged” and broke the lavatory door lock. The pilot then allegedly pulled Liebb from the bathroom while his pants were still around his ankles, exposing him to nearby passengers.

The legal filing further claims the pilot made antisemitic remarks about “how Jews act.” Liebb, described as a “visibly Jewish passenger,” was subsequently removed from the aircraft in handcuffs by Customs and Border Protection officers.

The lawsuit contends that when Liebb questioned why he was being detained, CBP officers responded by bending his arm and deliberately tightening his handcuffs, causing him significant pain. Liebb was then held at a CBP facility following the incident.

Lawsuit Against Airline

The legal case involving United Airlines passenger Yisorel Liebb has revealed additional details about events following the bathroom confrontation. Court documents indicate the pilot arranged for law enforcement to meet the aircraft upon landing.

When the plane touched down, Customs and Border Protection officers boarded and ordered all passengers to remain seated. Officers proceeded directly to Liebb and his companion, removed them from their seats, and placed them in handcuffs.

The lawsuit states both men were transported to a Homeland Security facility where they were handcuffed to tables and subjected to “intrusive, unconsented, unwarranted and unreasonable searches.”

Liebb claims he suffered injuries to his head and legs during the bathroom extraction, along with wrist pain from overly tight handcuffs. The plaintiffs are seeking compensation from United Airlines under Article 17 of the Montreal Convention, which holds airlines responsible for passenger injuries during international flights.

Following the widely publicized 2018 incident involving Dr. David Dao, United Airlines implemented significant policy changes regarding passenger non-compliance. Flight attendants now receive training focused on de-escalation techniques and are instructed to avoid physical intervention when possible.

United’s current approach typically emphasizes advising and reporting rather than enforcement, allowing the airline to address issues after flights conclude. However, the airline continues to train crew members to physically restrain passengers in rare situations where behavior poses an immediate safety risk.
